Apple's standard EULA also applies
Your use of the app is also subject to Apple's standard Licensed Application End User License Agreement (the “Apple EULA”), available at apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms and the Apple EULA conflict, the Apple EULA governs your license to the app.
1. License
We grant you a personal, non-transferable, non-exclusive license to use Hamsa on Apple devices you own or control, in line with the Apple EULA and these Terms. You may not copy, modify, reverse-engineer, or resell the app.
2. Subscriptions, trials, and billing
Hamsa offers auto-renewable subscriptions and a one-time lifetime option, with a 7-day free trial on subscription plans.
- Payment is charged to your Apple Account at confirmation of purchase.
- Subscriptions renew automatically at the then-current price unless canceled at least 24 hours before the end of the current period.
- Manage or cancel anytime in your Apple Account settings. Deleting the app does not cancel a subscription.
- If you don't cancel before your free trial ends, it converts to a paid subscription. Any unused portion of a free trial is forfeited when you purchase a subscription.
- Prices are shown in the app and may vary by region. Refunds are handled by Apple under its terms.
3. Acceptable use
Use Hamsa only for its intended, lawful purpose. Don't misuse the Service, attempt to disrupt it, or use it to violate anyone's rights.
4. Not medical or health advice
Hamsa is a wellness and focus tool. It is not medical, psychological, or health advice, and is not a substitute for professional care. App blocking depends on Apple's Screen Time framework and may not block every path to every app; do not rely on it for safety-critical purposes.
5. Intellectual property
Hamsa, its name, the bear mascot, designs, and content are owned by us and protected by law. These Terms grant you no ownership rights.
6. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. We don't guarantee the Service will be uninterrupted, error-free, or that blocking will work in all circumstances.
7. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability will not exceed the amount you paid us in the 12 months before the claim.
8. Termination
You may stop using Hamsa at any time. We may suspend or end your access if you violate these Terms.
9. Apple
You acknowledge these Terms are between you and us, not Apple, and that Apple has no obligation to provide support for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
10. Changes
We may update these Terms and will revise the “Last updated” date. Continued use after changes means you accept them.
11. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws rules.
